Terms of Use

Welcome to wagner&me. These Terms of Use ("Terms") form an agreement between you and Wagner & Me, LLC, a Texas limited liability company with its registered office at 1109 East Cesar Chavez Street, Austin, TX 78702 ("wagner&me", "we", "us"). They govern your access to and use of www.wagnerandme.com, our mobile experiences, and any goods or services we offer (together, the "Service"). By visiting the site, creating an account, or placing an order, you accept these Terms. If you don't agree with any part of them, please don't use the Service.

1. Who we are

wagner&me is a small fashion house designing and selling apparel, leather goods, accessories and home objects for people and the dogs they live with. Our atelier is in Austin, Texas. The site is operated from the United States and intended primarily for customers shipping within the U.S., the U.K., the EU, Canada, and Australia.

2. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. You may browse without an account. If you create one, you agree to:

• provide accurate, current and complete information;
• keep your password confidential and not share your account;
• notify us promptly at care@wagnerandme.com if you suspect unauthorised use.

You're responsible for activity on your account. We may suspend or close accounts that breach these Terms, are used fraudulently, or have been inactive for more than 36 months.

3. Orders & pricing

3.1 Order acceptance

Listings on the site are an invitation to treat, not an offer. Your order is an offer to purchase. We accept your offer when we send a shipping confirmation; up until then either of us may cancel the order. Some pieces are made in extremely limited runs and may sell out before payment is processed — if that happens we'll refund you in full within five business days.

3.2 Pricing & taxes

Prices are shown in U.S. dollars unless otherwise indicated. We may correct pricing or typographical errors at any time and will offer you the choice to confirm at the corrected price or cancel. Sales tax, customs duties and import fees are calculated at checkout where required, or are the customer's responsibility on delivery, depending on destination.

3.3 Payment

We accept the payment methods displayed at checkout. Payment is processed by our payment partners (Stripe, Inc. and Shop Pay); we never store full card numbers on our servers.

4. Shipping & risk of loss

Estimated dispatch and transit times are shown on each product page. Risk of loss and title pass to you when the courier confirms delivery to the address you supplied. If a parcel is lost in transit, contact us within 21 days of the dispatch date and we'll resolve it directly with the carrier.

5. Returns, exchanges & repairs

5.1 Standard returns

Unworn, unaltered pieces with original tags may be returned within 30 days of delivery for a full refund to the original payment method. Personalised items, final-sale pieces and intimate goods are non-returnable except where defective.

5.2 Repairs for life

We will repair any wagner&me piece, free, for the natural lifetime of the piece. The customer covers shipping to the atelier; we cover everything else, including return shipping. This is a promise, not a warranty — it doesn't affect your statutory rights.

6. Intellectual property

The Service and everything on it — text, photographs, illustrations, the wagner&me wordmark, the dog silhouette mark, product designs, and the look and feel of the site — is owned by us or our licensors and is protected by copyright, trademark and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to view the site for personal, non-commercial use. You may not copy, scrape, reproduce, modify, mirror, frame, sell, train machine-learning models on, or otherwise exploit any part of the Service without our prior written permission.

7. User content

If you tag us, send us photographs, post reviews, or otherwise submit material to us ("User Content"), you grant wagner&me a worldwide, royalty-free, non-exclusive licence to use, reproduce, adapt and display that material in connection with our marketing and the operation of the Service, with attribution where reasonable. You confirm that you own or have the rights to the material and that it doesn't infringe anyone else's rights. You can ask us to stop using a specific piece of User Content at any time by writing to care@wagnerandme.com.

8. Acceptable use

You agree not to:

• use the Service for unlawful, fraudulent, harassing, or harmful purposes;
• interfere with the Service's security, availability, or integrity;
• use bots, scrapers, or automated tools to access the Service except for indexing by general-purpose search engines that respect our robots.txt;
• attempt to gain unauthorised access to any account, system, or data;
• resell our pieces commercially without our written consent.

9. Disclaimers & warranties

Goods sold by wagner&me come with the statutory consumer guarantees that cannot be excluded under applicable law. Beyond those, the Service and its content are provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that the colours shown on screen exactly match the finished piece.

10. Limitation of liability

To the maximum extent permitted by law, wagner&me, its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total cumulative liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or anything else that cannot be excluded under applicable law.

11. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The state and federal courts located in Travis County, Texas have exclusive jurisdiction, except where you are a consumer protected by the mandatory laws of your country of residence — in which case you may bring proceedings in the courts of that country and benefit from those mandatory protections.

Before filing a claim, please write to us at care@wagnerandme.com; we'll respond within 14 days and try to resolve things amicably.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. If a change materially reduces your rights, we'll give you at least 30 days' notice by email (if you have an account) or by a banner on the site. Continued use of the Service after the effective date means you accept the updated Terms.
